The website operator (hereinafter: "the Operator") authorizes access to this website under its control and known as "Asufa Ltd." and to the services subordinate to this website and available from the domain name and sub-domains of the website, all subject to the terms of use detailed below.
You confirm that you have read the terms of use of the website detailed below, and that you agree to use the website subject to the terms detailed below. You agree to read all the terms detailed below before starting to use the website. If you do not agree to accept the terms detailed below, you are not authorized to access, utilize or use the website.
We may change and/or edit and/or update the terms of use from time to time. You are invited to check the page from time to time to ensure that you are familiar with all changes. The latest version, version 1.1, was published on 9.6.2024.
Introduction
These terms apply to the use of the website and the content contained therein using any computer or other communication device. (such as a cell phone, various handheld computers, etc.). These terms also apply to the use of the site, whether via the Internet or via any other network or means of communication.
For your information, the operator reserves the right to change, at its discretion and without obtaining the user's consent, the terms of use of the site. Each time you access the site, you will be able to read the terms of use in their most recent version, the link to which appears at the bottom of the site.
These terms of use are added to the provisions of any other regulations found on the site, and in the event of any inconsistency, the provisions of the specific regulations prevail.

Purpose of the Site
This site is a site for selling home decor, fashion, gifts and souvenirs.
Site registration process
The site registration process may require the user to provide the following information;

The user's ID.
The user's first and last name.
The user's e-mail address.
The user's residential address.
The user's telephone number.
By law, you are not required to provide the information specified above, but without providing complete and accurate information, you will not be able to use the site's services.
You know that submitting incorrect information is a criminal offense under the law.
If and when the operator finds that the registration or order information you provided is incorrect or inaccurate, the operator reserves the right to take legal action against the user for damages caused to the operator, anyone on its behalf, service providers or any third party due to providing incorrect information.
Liability

Even if the operator and/or its representatives knew and/or were informed of the possibility of such damage, which will be caused to you or to any party other than you.
Use of the site constitutes your agreement to exempt the operator from any liability, meaning exemption from any liability for direct and/or indirect damage and/or harm to the user and/or any third party.
This agreement does not create and does not intend to create any employment relationships, supplier-customer relationships, partnership relationships, joint venture relationships, franchise relationships and agency relationships.
Subject to the reservation of any provisions of any law that dictate otherwise, the Operator does not express any position and is not responsible, expressly or impliedly, for:
Regarding the content, material, information and actions that are accessed through access to the Site;
Regarding any product, software or services that are accessed by creating an electronic link from the Site;
Regarding any damage that is caused or may be caused by the transmission of confidential or sensitive information through the Site;
Regarding any damage that is caused or may be caused by a defect or malfunction in the software that operates the Site or that allows access to the Site.
Products sold on the Site
The images of the products sold on the Site are for illustrative purposes only. There may be differences and changes between the appearance of the products in the images and the products that will actually be supplied.
The Operator may, at its sole discretion, change the list of products offered on the Site and the structure of the Site without giving prior notice.
The operator may post benefits or promotions for limited periods of time, at its sole discretion.
Online orders via the site
Purchase on the site will be made via an online order form in which the user will be required to select the products he wishes to purchase.
On the site, orders and purchases of products offered by the operator can be made, in accordance with the operator's possible payment channels. Payment for the service or product will be made before receiving the service or product.
When placing an order by the user, the operator will check the credit card details entered and upon receipt of order confirmation by the credit card company, the order will be confirmed and the user will receive a notification to the email address entered on the site. If the transaction is not approved by the credit card company, a notification will be sent to the user and he will be required to provide another means of payment. Shipping dates will be calculated from the date of receipt of transaction confirmation from the credit card company.
In any case of delay in making the payment, the operator will suspend the user's account, until the payment issue is fully clarified and full payment is actually made.
Tax invoices will be sent to the user via email to the email address entered by the user at the time of registration.
Product prices on the site include VAT.
Products on the site are sold while supplies last. If the product is no longer available, the operator's representatives will contact the user to select an alternative product or refund the payment.
Product Delivery
The Operator will ship the product purchased through the Site via a delivery company at the times specified below:
Product in the Operator's inventory - the product will be shipped within 4-7 business days of making the purchase.
Product manufactured by the Operator - the product will be shipped within 14 business days (after the end of production).
The delivery days begin to be counted from the next business day after the credit card company's approval, for those ordering by 6:00 PM.
The business day begins to be counted from the first day after placing the order that is not a Friday, Saturday, holiday or other date.
During periods when there are special promotions on the Site, delivery times may be longer than usual.
The shipping fee will be paid by the Customer separately as part of the payment for the product.
A user who purchases a product on the Site has the option of picking up the product in person, in advance of the Operator's customer service.
The Operator is not responsible for any delay in the delivery of the service or product purchased on the Site as a result of factors beyond its control.

Cancellations and Returns
A user who wishes to cancel a purchase made through the site will act in accordance with the provisions of the Consumer Protection Law 5741 - 1981 and the Consumer Protection Regulations (Cancellation of a Transaction), 5771-2010.
A user may cancel a transaction and return the product within 14 days of receiving the product, against payment of a cancellation fee of 5% of the price of the goods or service or 100 new shekels, whichever is lower.
A product exchange will be possible within 60 days (except for the exceptions specified in sections 8.4, 8.5 and 8.6) from the date of Receive the product, in its original packaging that has not been opened and the product has not been used.
Products created on a custom order (products according to special measurements or requirements) cannot be returned. Products created on a custom order can only be exchanged within 14 days of receiving the product.
Clothing items can be returned or exchanged within 14 days of receiving the product, in its original packaging that has not been opened and the product has not been used.
An item purchased as part of a set cannot be returned or exchanged, but only the entire agreement with all its details.
A product can be returned or exchanged at one of Asufa stores in Tel Aviv. The operator must be contacted before arriving at one of the parking lots by email at shop@asufadesign.com or by phone at 054-8109145.
Products that were damaged while in use cannot be returned or exchanged.
Privacy

The operator makes reasonable efforts under the circumstances to protect the user's information and privacy. However, due to the nature of the network, it is not possible to guarantee complete protection of this information.
The data you provide when registering on the site will be stored in the site's database. By law, you are not obligated to provide the information, but without providing it, you will not be able to use the services on the site.
We consider maintaining user privacy to be a top value. The operator will not rent, sell or transfer the user's personal information to third parties for marketing purposes without your express consent.

The user will not have any claim in the matter arising from information that has reached third parties as aforesaid, and the user will not have any right to claim, claim or demand against the operator in the matter arising from that information. The user on the website releases the operator from any liability for any direct or indirect harm or damage, financial or otherwise, that may be caused to the user as a result of the leakage of such details, regardless of the reason for their leakage.
The operator will transfer the user's details in the following cases;
For the purpose of realizing the purchase of a product.
When the operator believes that a user on the website has committed/is committing an action that may harm the operator, someone on its behalf or the parties Third parties.
If the operator believes that the user is using the site in a way that may enable, encourage or assist in the performance of an act that is illegal or does not comply with these terms of use.

Trademarks
The Operator's name, the Site's domain name and the Operator's trademarks are the exclusive property of the Operator. All other marks on the Site are proprietary trademarks of their respective owners. No action may be taken that may infringe the proprietary rights to the trademarks.
Termination of Use
The Operator shall be entitled, at its discretion, to immediately, unilaterally and without prior notice, to discontinue the provision of services under this Agreement, without any remedies being taken against it.
The Operator shall be entitled, at its discretion, to terminate the activity of any user on the Site if he fails to comply with any of these Terms of Use.
The Operator shall be entitled, at its discretion, to block a user from accessing the Site, block an IP address from accessing the Site, remove a user from forums on the Site, prevent a user from posting Talkbacks on the Site and prevent a user from using any service provided within the Site.
Jurisdiction
This Agreement shall be governed by the laws of the State of Israel. The exclusive jurisdiction to discuss any dispute arising from this Agreement shall be vested in the Tel Aviv Court.
This contract shall be subject to the provisions of the Contracts Law (Remedies for Breach of Contract), 5731 – 1970. Without derogating from the generality or derogating from the remedies provided under the provisions of any law.
